Lawyers and the Accountability

We are humans and we often make mistakes, like lawyers know the law but even then they also make mistakes, being human. They are not God or above the law’s reach. Lawyers of Dubai, are declared accountable for the actions they take and work professionally, sensibly, and ethically. That is why Lawyers in Dubai are having high profile respect and the profession is considered respected in Dubai. People come to Dubai from other countries just to be Legal Consultants/Lawyer here. Please be noted that only UAE citizens can be full Advocates in Dubai, others are only Legal Consultants or can also be called Lawyers due to their multiple roles but they can’t be called Advocates. Advocates in Dubai means Emirati Advocates and Lawyers. You can even sue your lawyer if they don’t behave ethically and professionally. Before that, you must know that you are using them for the right purpose and must know your rights as well. The accountability which heavily falls over advocates in Dubai, also makes these lawyers the best advocates and legal consultants. The client can also turn against the advocate or legal consultant(licensed)if he is betrayed or cheated by the Advocate. They can easily be sued on a number of things that are, Misrepresentation, Negligence, unprofessional attitude, malpractice, inappropriate billing, and many more. It can be expensive work to do, so before doing this, meet with your lawyer before the trial and put the cards on the table, try your best to solve the matter outside the court, register your complaint to the Bar Association. If nothing works, then go for it and make a case on them. The Ruler’s Court or Diwan Court is the place where Lawyers/Law Firms can be taken by those clients who have been cheated. To make it effective while proceeding against the lawyer, the following points must be kept in mind by the client from the beginning:

• Keep all the records with you, your phone calls, meetings, contracts, documents, and whatever your thing is important for that.
• Prove how much this case cost you in every possible term.
• Give proof of breaching their duties and negligence towards the case.
• Clearly establish that they are not performing properly.
• Keep all documents and their progress with you to show them where it has all started and now at what point the case reached.
• Proof them that initially, the lawyer helped but then left the case with juniors and assistants.
• Proof in the court that your case has gathered dust while your lawyer was busy with other clients who were giving them more money.
• Have proof of all bills and show them in the court that they misappropriated your bills and asked for more money than required. 
• Communication, updates by the Advocates and legal memos of the Lawyers play a very big role. All this stuff must be in written format and properly organzied.
• Please keep in mind the complaint rejected by the Diwan can also turn against the Client. Lawye can file the Civil Case against the Client. So, its a quite technical thing.

Lawyers are related to these malpractices and it is very sad to see this such a highly paid profession with so much corruption. They even forget that they took vows before their practice which is totally unethical and immoral. Every person in the country has a right to justice and if you find out that a lawyer is not working professionally then sue them. However, Dubai does not see or observe such professional malpractice a lot. The criteria to get the license and do practise in Dubai is quite organized and strict made by Dubai Government.
