When Family Lawyers are Needed
Family Lawyers are needed, though not a good option. Nobody wants to break his relationship and his career. It’s a quite painful process. Therefore the first action should be mediation. The same is advised and adopted by Family Courts too. Therefore when family courts are contacted for divorce or to settle any kind of family dispute, then as per Sharia Law or the UAE Law, first mediation sessions are organised.
These can be at least two or a maximum of three sessions, even though the couple has decided to get their ways apart. The mediation session is conducted by the Court itself where the advocates from both sides are not allowed.
Lawyers/Advocates can also spoil the relationships for commercial purposes. Therefore the Advocates are not allowed to join their clients or the sessions indirectly. If it is not fixed or settled then the request is sent to the next phase which is a Court Case. A “Court Case” means, a case number is registered and when a case number is registered then it means it’s now inside the Court where lawyers can represent their clients.
Lawyers need Power of Attorney here too, like in other cases e.g. Real Estate Cases, Labour and Employment Cases, Wills and Estate Cases, Defamation Cases, Commercial Cases, Civil Cases or even Criminal Cases. Once the Power of Attorney is provided then, lawyers can do anything. They can submit the statements, defence, and proofs, bring witnesses as well as clients to court, but as per the situation and demand.
