In the UAE, the case file regarding marriage termination comes under the legal bracket of Federal Law NO. 5 and Federal Law No. 28. The latter legislation is also known as the Personal Status Law or PSL. This law incorporates the basic principles of Sharia Law. Under the UAE Law, the mother is not legally obliged to pay any financial compensation for child maintenance, whether she gets the child custody or not.
As per the Federal rulings, the father will always be the legitimate custodian of the child. In this regard, he will be the financial caretaker of his child as well for life. Under any circumstances, he cannot claim any financial remuneration from the mother, irrespective of her financial status. The father has to pay for the child’s residential expenses, food sustenance, clothing cost, travelling expenses, and a maid’s salary.
