Family lawyers in Dubai are also referred to as divorce lawyers. Because this term is somehow interrelated with each other. People often get confused that these two are not the same but in reality, family lawyers and divorce lawyers are the same. In the past when there were few cases of divorce then there was no need for any lawyer who was specialized in this (divorce) field. Now with the passage of time divorce rate is increasing day by day so there is a need for those lawyers who are specialized in this. United Arab Emirates has to be much careful in this regard. People from different backgrounds are working in the United Arab Emirates. They have different religious, cultural, and heritage backgrounds. Sharia Law can’t be implemented on all the people living in UAE. Especially the amendments that came in 2020, created big flexibility for the expatriates. Divorce Law is always part of Family Law and Divorce Lawyers in Dubai are meant to be Family Lawyers in Dubai. It includes all these things which are discussed below:
Child Support:
In this Child Support, there is an amount that has to be paid by the Non-Custodial parent to support their basic needs, if there is any child in this marriage. This amount is used for their clothing, education, food, and shelter. It is decided by the Court as per the age of child/children, place the child would be kept by mother, affordability to pay, etc.
Child Custody:
In some cases, one of the parents gets the physical custody of their child but it’s dependent on the child with whom he or she wants to live. But, if a child is an infant then child custody has been given to that parent who is able to bring him or her up well and is eligible to fulfill the needs of that child. Some parents were given joint parenting to their child for a healthier mental and physical brought up of their child. But up to the end of early ages, custody is given to the mother. Usually, the girl’s age is 13 and the boy’s age is 11.
Division of Assets:
This one is the difficult one in which all assets are included like, Property, House, Plans of Investments, joint insurance, joint business, joint dividends, etc. All those things which are planned after the marriage will come under the division between the spouses. Property that is owned by one of the spouses before marriage does not come under this division.
Visits:
Visits are the time that has been given to the non-custodial parent by the court so that they can able to meet their child. Court has decided days and times which that parent is allowed to meet his or her child.
Relocation:
Many couples after the divorce relocated to some other town or city for their employment. A difficulty for the non-custodial parent this way. A non-Custodial parent can’t meet a child the way he wants or he has an ease to meet. But, before relocation, the custodial parent has to submit the documents to the court for approval.
Conclusion: There is nothing like Family Lawyers or Divorce Lawyers separately. All are together and considered to be offered by one Lawyer. Previously there has been a separate entity for a Law Firm as Family Law Firm but nowadays the Law Firms are operating as Full-Service Law Firms and called with different names e.g. Law Company, Full Service Law Firm or Law Office. All the Law Offices are Emirati Law Offices and are owned by Emirati Advocates. Please make sure that these Law Offices should also be owned and led by Emirati Lawyers.
